Eastman and Trump attack the Constitution – Press Enterprise

“Based on the evidence, the Court finds it more likely than not that President Trump corruptly attempted to obstruct the joint session of Congress on January 6, 2021,” the district court judge said Monday. American David Carter, ordering former Chapman University law professor John Eastman. to communicate key emails to the House of Representatives Jan. 6 committee.

Eastman, who quit Chapman a week after the Jan. 6 attack on the Capitol, used his Chapman email address to discuss his plan to overturn the 2020 presidential election results and tried to shield the e-mails, invoking attorney-client privilege.

“If Dr. Eastman and President Trump’s plan had worked, it would have permanently ended the peaceful transition of power, undermining American democracy and the Constitution,” Justice Carter, perhaps best known locally for his involvement in cases of homelessness in Orange County and Los Angeles, concluded.

Indeed, while Eastman and his followers claim to be the defenders of American institutions, they are clearly anything but.

Eastman’s bizarre plan called on Vice President Mike Pence, who was responsible for overseeing the ceremonial counting of state electoral votes, to halt the electoral vote counting of key states.

“The bottom line here is that Pence do so without asking permission — either from a vote of the joint session or the court,” Eastman’s memo pointed out.

Fortunately, Pence knew better and refused to go along with the plan, which was clearly an attack on American democracy and the Constitution.

Pence’s legal team, per Justice Carter’s ruling, made it clear to Eastman the illegality of his plan.

“The evidence also demonstrates that Dr. Eastman likely knew the plan was illegal,” Justice Carter wrote, noting, among other things, that “Pence’s attorney spent hours rebutting every part of the plan to Dr. Eastman.” .

“Dr. Eastman likely acted in a deceptive and dishonest manner each time he pushed a results-oriented plan that he knew was not supported by law,” Judge Carter concluded.

The record establishes the extent of Eastman’s involvement in this madness.

“The ‘siege’ is because YOU and your boss failed to do what was necessary to allow this to be released publicly so that the American people could see for themselves what happened,” he said. writes Eastman on January 6, during the attack. , in an email to Pence’s attorney, Greg Jacob.

Eastman to this day defends his actions as righteous because he was in fact defending American democracy against voter fraud. It does not make sense. All 50 states have certified their election results. Audits and courts confirmed the election results. There was no electoral fraud. To believe otherwise at this point is to be drunk on conspiratorial Kool-Aid.

What President Donald Trump and John Eastman wanted to happen was not a defense of democracy or the Constitution. It was an attack on both. Any sane conservative, constitutionalist, or libertarian should be able to admit that out loud.
